The Court solves the financial crisis, the change process

By Jon Ralston (contact) Friday, may 27, 2011 | at 2: 01

Carson City — Serial thieves live legislative building, which every two years pillaging local sources because they do not have the courage (or votes) to adopt thoughtful fiscal policy, has finally been called to their purloining the only branch of Government that could.

And instead of calling a press conference to present the error looks sheepishly on their way to the Supreme Court declared a 62 million dollar brazen robbery illegal, legislative leaders are using the decision … attempts to push through an infusion of 700 million dollars in the State budget. (Gov. Brian Sandoval, a move that will break the budget impasse, is expected to announce today that he will use the 700 million dollars from business and sales taxes that would expire to a burgeoning holes created by the High Court ruling.)

Legislator – who have spent an entire session that talks about what they look for children – have set entirely in the example for Nevada's kids: If you behave badly and get caught up, turn it to your advantage.

Thus the Democrats ' last-gasp attempt to lift the sunsets on the expiring taxes profit life as Session "11 winds, with 62 million $ holes at least of their problems that threaten to hundreds of millions in Sandoval's budget. And it doesn't take a long time – maybe a minute after the decision was issued on a case involving the dying clean water Coalition – for democratic legislatures to say ' I told you "on the administration of the gimmickry that raids school bond reserves, Because shame owns a 120-day vacation here in odd-numbered years, none of the lawmakers appeared red-faced about criticizing the budget be fooled by such that they are all too happy to use – and has, session after session.

The short-term effect of a court decision is a deus ex machina to resolve the budget impasse. But the long-term consequences, Sandoval said, "the far-reaching consequences of the Nevada Governors and legislatures will continue to do business from this date forward."

In fact you almost imagine the conversation of the gods over the farm that they saw legislators slabs and Governor threatens: "we have enough problems that probably solve redistricting in a few weeks. We certainly do not want any of this budget nonsense of our docket. Remember what happened in 2003: the tax decisions had dragged and it costs a few judges their careers. But if we have decided this case right now, it could start the dominoes falling, and we can get them out of the capital in time.

Or words to that effect.

The opinion, that can be found on tinyurl.com/3ozc45k, can finally put an end to the practice of abdicating responsibility Biennale in the capital, and stealing from the local governments. Why? Because they can – or thought they could.

This Gang of 63 Willie Sutton town, sometimes supported by Governors – often abandons political talks and tough choices along cobble patchwork budget and taxes, and packages that make little sense but reach a consensus. It is infuriating-having a calculator rather than discuss political choices.

The Court decision should be greeted with joy from both sides of the political spectrum. It will force Governors and lawmakers to actually do pass cuts or adopting new taxes, without the least resistance because local people have been helpless to resist difficult decisions. Budget bus lines that characterize each session may be reduced significantly by this Court's opinion, that reminds lawmakers their power is not absolute and is reined the Nevada Constitution.

Article 4 has two relevant provisions. It says lawmakers ' shall not pass local or special laws "and law" must be universal and uniform throughout the State. "

There, on its face, appears to be taking money from local governments or school districts. It appears that the Court confirmed Thursday that legislators should not do what they have always done.

Until some of them paid to clean water Coalition decided to sue – the locals have for years after threats from legislators cowered as has so much power over them – this unconstitutional law has been accepted, even becoming the big here. This makes it easier to "found" money to balance budgets instead of hash in political elections.

Nothing more.

It appears at the end of 2011 legislature can be less painful than first believed. Governor to use the Court decision as a reason to lift the sunsets and will have to get rid of loose enough Republican votes to gain the necessary two-thirds.

But the real impact of the decision will be felt first in 2013 and then sessions in addition to which legislators and Governors really need to do something the Court decision is now forcing them to do their jobs.
