Society cannot tolerate random acts of violence

Recently, which I am biking to work, I was the victim of a random act of violence that someone threw a bottle of watered-down drinks in me trying to knock me off my bike.

My quick reflexes and conditioning was apparently, far superior to the antagonist that nothing happened to me.

This pathetic and childish incident caused me to reflect on the problems with random anonymous violence which cost many Americans their lives. Gone are the days when "men were men," and faced each other on a. Today honor many lost souls with inner demons lack, dignity and decency, while hiding behind their cars, guns, gangs, freeway overpasses, etc., and protrude their anger on innocent, unsuspecting victims.

In my case, instead of realizing that by bicycle traffic, I reduce petrol consumption (which reduces costs for all), road congestion and pollution and threw angry and deranged person quite good, chilled and nearly full drink at me because either he was jealous that I can bike 20 miles in 100 plus degree heat or just because he could do it anonymously and get away with.

We cannot survive as a society with this type of behaviour and must identify, report and prosecute persons who unpunished crimes encourage antisocial more vicious crimes.

It is also time for many drivers to behave more civilly on the roads and for our law enforcement authorities in order to improve this crisis/epidemic here so more people are seeking alternative forms of transportation.

With Osama bin Laden at the bottom of the sea with SpongeBob SquarePants, I nominate Goldman Sachs as the next existential threat to America. They are hiding out in EasyMoneystan on the island of Manhattan. Since their “perfect crime” of 2008, which they got away with, they continue to innovate. Speculative commodity bubbles in corn and oil, resulting in higher food and gas prices, repackaging of toxic Greek bonds that threaten all of Europe with a euro-destroying debt crisis, and the sale of our state and city parking meters, toll roads and other public infrastructure for 75 or 100 years to foreign sovereign funds are just the most visible and recent examples of their amoral pursuit of profit.

Let’s send SEAL Team 6 to Wall Street!

Both have cost more than $1 trillion each, and still the war continues in Agrostan, and the Wall street bankers continue to do very very well on the backs of the US taxpayers, with huge salaries, huge huge bonuses, they really must be laughing all the way to the banks....................just when will you people ever ever learn

To help those in need

Charitable giving is an integral part of the American spirit, if there is a donation of canned goods to the local soup kitchen, volunteer work to rebuild a community ravaged by a tornado or hurricane, or economic aid and medicine be sent abroad to stem the spread of hunger and disease. This generosity has its limits, especially during economic experiments. But there is fresh evidence that the country's economy is growing gradually from the great recession, at least as far as donations are.

Evidence of this, it was reported Monday by the Foundation giving in Chicago and his research partner, the Center on Philanthropy at Indiana University, United States. They found that the charitable contributions by American individuals, companies and foundations in 2010 totaled more than 290 billion dollars, a 3.8% increase compared with the previous year in actual dollars and a 2.1 percent increase for inflation.

After the 2008 and 2009 witnessed the sharpest declines in American offers in more than 40 years, it is a welcome relief to see an uptick in donations. There was an increase for education, art, culture and public-society benefit organisations such as United way. As Edith Falk, President of the United States, to give these increases came despite the fragile economic recovery. " To the Americans should be proud of.

But the News is not all the light. Patrick Rooney, Executive Director of the Center on philanthropy, said "the sobering reality is that many donated is still wounded." He also said that if only grows at the rate it did in 2010, "it takes five to six years only to return to the level that we saw earlier great recession."

Boston Globe columnist Derrick Jackson also correctly identified another sad reality: the increase in charitable giving "pales in comparison to what will be removed in the current siege of cuts in the budget." Jackson was referring to how social service budgets in Washington. But Nevadans knows how it is that inadequate social service program since population growth never pays for itself.

Now that the State is enduring prolonged economic difficulties, as evidenced by record layoffs, foreclosures and bankruptcies, are even greater demand in Nevada to a stronger social safety nets. The cruel reality is that the State has been unable to give much support. Nevada's outdated tax system has enabled many companies to go virtually untaxed in years, and has submitted important services without adequate funding. Efforts to change the system over the years have failed, and has submitted a little Government help for Nevadans who need it most.

The who expect charities to compensate for the difference is very wrong. But since donations are needed more than ever, all of which contribute in a charitable manner deserves nothing but the highest praise from a grateful community.

President Obama declared June 2011 as Great Outdoors Month, an awareness campaign and celebration of outdoor recreation and preservation with a nod to natural landscapes and neighborhood parks. While Southern Nevada is noted for its designated conservation areas and national recreation sites, it also has urban and suburban spots worthy of visiting for those dying to get outside in 100-plus temperatures but have no cash for gas, are commuting by foot or bus passes.

The Lewis Avenue Pedestrian Corridor has a great little footbridge featuring poetry by 20 writers who have, at some point, called Nevada their home. Located in Downtown Las Vegas across from the Foley Federal Building, next to the Historic Fifth Street School, under the beating sun and amid the urban soundtrack, the Poets Bridge is a fitting place to meditate on life in Las Vegas while inspired by the words of Gregory Crosby, Dayvid Figler, German Santanilla and others.

Completed with formal landscape — desert plants, a shallow river and decorative stone — the pedestrian area, (also a popular hangout for the city’s homeless people), is a result of a Centennial Plan beautification project and includes Crosby’s “The Long Shot,” a poetic account of the unimaginable Las Vegas story, a city built on dreams in the most unlikely of places. That story continues in adjacent Centennial Plaza where artist Stephen Hendee’s “Monument to Simulacrum,” an angular and formidable 12-foot-high stainless steel sculpture embodying Las Vegas’ perseverance in an extreme and hostile environment.

The Lewis Avenue Pedestrian Corridor is located at Fourth Street and Lewis Avenue, Downtown.

Heritage Street

The homes lining Heritage Street, a tree-lined gravel stretch of local history at Clark County Museum, tell stories of noted residents, decades and events of the 20th century. The five homes include a Tudor revival decked in swank ’50s design and a 1912 California Bungalow, depicting life in the 1920s for the Beckley family, who owned a Las Vegas clothing store. A stand-alone room from a motor court (with a 1946 Plymouth parked outside), The Boulder City Depot, a print shop and the Candlelight Wedding Chapel are part of the walk-through collection. And yes, the structures are air-conditioned for your comfort (as opposed to historical accuracy).

Flamingo Arroyo Trail

The Flamingo Arroyo Trail that lines the Las Vegas wash includes art enhancements designed by noted artists Kevin Berry of Phoenix, Barbara Grygutis of Tucson and Buster Simpson of Seattle. Sit under the Pauite-inspired steel shade shelter at the Pecos-McLeod trailhead for a meditative experience, wander through the desert landscape designed in response to the environment, then walk the pedestrian trail.

Seating areas were made of discarded rubble, including stairs from the imploded Stardust swimming pool.

The trail is located off McLeod Drive, south of Desert Inn.

Labyrinth
The St. Andrew Catholic Community church labyrinth in Boulder City

The grounds of St. Andrew Catholic Community include a labyrinth accompanied by benches, a desert garden and sculptures. Walk its path in the daytime or stroll it in the evening. The labyrinth is lighted until 10:30 p.m. daily. Even in extreme temperatures, it’s a worthwhile trip for anyone looking to get away and get inward. Make a day of it and visit Boulder City’s shops and restaurants.

Take a guided tour through the Neon Museum’s outdoor collection of large-scale and historic metal neon-and-bulb signs. The 150-plus sculpted iconic signs and their scripts forming the Boneyard’s gravel walkway provide a visual narrative of Las Vegas. The collection includes signs from Downtown Las Vegas, the Las Vegas Strip and local businesses. Again, worth the journey no matter how hot it gets in the summer.

Sam Morris Michael Heizer’s “Double Negative”

If you’ve found some extra cash to fill the gas tank and want to explore the outdoors while pontificating the idea of a doubly negative space, head 80 miles northeast of Las Vegas to see Michael Heizer’s “Double Negative.” The 1,500-foot-long, 30-foot-wide, 50-foot-deep earthwork near Overton is one of the largest sculptures in the world, and was completed in 1970 by scooping away 240,000 tons of rhyolite and sandstone to create trenches that are connected by a center canyon. The Museum of Contemporary Art in Los Angeles owns the sculpture that is worthy of visiting if you don’t mind a bumpy drive into the rugged desert.

Man wounded in shooting outside the convenience store

A man was in serious condition Friday night after being shot outside a convenience store in northwestern Las Vegas, said Metro Police.

The shooting occurred about 10: 15 p.m. outside a 7-Eleven store on 870 n. Rainbow Blvd. near Washington Avenue, said police.

The man was shot once in the hand and was transported to University Medical Center with serious but non-life threatening injuries, said Lt. Dan McGrath.

McGrath said investigators believe the shooting may be gang-related. No suspects were in custody, he said.

Witnesses gave only a vague description of the shooter and the investigator may determine if the shooting was captured by the store's surveillance cameras, McGrath said.

Earlier this year, gave Las Vegas Councilman Ricki Barlow students at a North Las Vegas elementary school a special challenge.

Improve performance on standardized test criterion referenced and Barlow would treat high-performing students to a pizza party and prices as bicycles and backpacks full of school supplies.

This Friday rejoined Barlow to Quannah McCall Elementary School, 800 Carey Ave., congratulate the few dozen summer school students to achieve the highest score in school history.

-I am here today to live up to the end of my favourable because more than 124 students have surpassed CRT exam, "said Barlow. "I am very proud of these kids."

According to unofficial CRT scores, McCall still has room for improvement, with two thirds of the fourth and fifth graders passing the math portion of the CRT and about half of the fourth-and fifth-v?ghyvlar cross section reading. In third class, only 53 percent passed math and 34% passed reading.

This year's points, however, a major improvement from the previous year, according to Principal Maria Chairez. When she joined McCall 2005, Aino only 11 fifth-v?ghyvlar cross section, the treatment of the CRTs.

This year's better scores 42% in reading and mathematics from 56% in the last year, Chairez said, adding that she feels confident McCall will meet its annual yearly progress designation again on the no child left behind.

"We are very proud of our growth," said she. "Quannah McCall is on the move. We hope that a turnaround school in North Las Vegas. "

"Everyone has the right to do what they want to do in a free market system," said the Huntsman. "That's what is great about America because in China, you would never be able to do this."

Huntsman said he saw the "last part" of Amodei's ad, which contains a mock Chinese newscast describes a Chinese Empire financed by American debt. The final image is Chinese troops marches on the u.s. Capitol. Amodei, who oppose raising the debt limit, said he used the inflammatory images to provoke a conversation about the dangers of the country's growing debt.

"We see how effective it is," said the Huntsman.

The advertisement has been criticised as racist and potentially damage Nevada trade relations with China. Nevada's exports to China have grown exponentially over the last decade and is still an important tourism market for the State.

As it works to continue its lawsuit campaign, Las Vegas newspaper copyright enforcement company Righthaven LLC is saying that case law in the patent field supports its litigation-driven business model.

In one of the first Righthaven court filings signed by Dale Cendali, Righthaven’s new star attorney with the law firm Kirkland & Ellis LLP in New York, Righthaven this week urged U.S. District Judge James Mahan to uphold its right to sue over Las Vegas Review-Journal material.

Righthaven faces an uphill battle, as U.S. District Judge Philip Pro this week ruled Righthaven doesn’t have standing to sue even with recent amendments to its lawsuit contract with the owner of the R-J.

The problem with the contract and copyrights assigned to Righthaven is that Righthaven still doesn’t gain an exclusive right in the copyrighted material — and that exclusive right is needed to have standing to sue, Pro ruled.

Nevada’s Chief U.S. District Judge Roger Hunt adopted Pro’s interpretation of the amended contract in dismissing two Righthaven cases this week. Last week, Hunt threw out another case based on the original lawsuit contract.

And Mahan has been openly critical of Righthaven and its policy of using copyrights for lawsuits.

Righthaven disagrees with Hunt and Pro about its standing to sue, the company’s attorneys wrote in a filing Wednesday with Mahan.

“Righthaven undoubtedly owns the copyright under the recently executed amendment,” the filing said.

“Righthaven respectfully disagrees with Judge Hunt’s decision.” About Pro’s ruling, it said, “Righthaven disagrees with that decision and intends to appeal.”

In defending Righthaven’s lawsuit-driven business model, Cendali and another Righthaven attorney, Shawn Mangano, cited case law that found patent assignments made for the sole purpose of filing lawsuits are valid; and that a patent grant for litigation was valid even with the grantor retaining several rights related to the patent.

“It is well-established that in copyright law, as in patent and trademark law, parties other than the original owner-creator may acquire the intellectual property rights and sue for infringement,” Righthaven’s filing said.

If this were not true, “countless nonpracticing entities would be deprived of standing to bring patent infringement claims,” Righthaven’s filing said.

“Nonpracticing entities” are known in the intellectual property law field as entities that use patents for licensing and litigation purposes. Although some are considered legitimate, well-capitalized companies, others are considered opportunistic “patent trolls.”

Righthaven’s likening of its business model to the patent field will no doubt be of interest to one of its main litigation foes, the Electronic Frontier Foundation in San Francisco.

The foundation has its own patent law experts and a “Patent Busting Project” aimed at fighting illegitimate patents, particularly in the software and Internet fields that target individuals and that the foundation says threaten free expression.

“More and more people are using software and Internet technology to express themselves online. Website and blogging tools are increasingly popular. Video and audio streaming technology is ubiquitous. Email and instant messaging have reached users of all ages. Yet because patents can be anywhere and everywhere in these technologies, the average user has no way of knowing whether his or her tools are subject to legal threats. Patent owners who claim control over these means of community discourse can threaten anyone who uses them, even for personal noncommercial purposes,” a foundation report says.

As for Righthaven likening its business model to “nonpracticing entities” in the patent field, one Righthaven observer was skeptical Friday.

“The invocation of patent law as a guide for a copyright case struck me as a little desperate. While courts sometime cross-pollinate between the two doctrines, the copyright statute has very specific requirements for standing to sue as well as a 9th Circuit (Court of Appeals) case directly on point. Righthaven reached for patent law analogies because the more directly applicable law wasn’t favorable,” said Associate professor Eric Goldman of the Santa Clara University School of Law in California and director of its High Tech Law Institute.

Another attorney said “nonpracticing entities” and patent trolls typically do gain full control of patents — something Righthaven is working to establish it has done with its amended lawsuit contract for Review-Journal material.

Separately involving Righthaven, an attorney representing Righthaven defendant Dana Eiser in South Carolina on Thursday filed a massive, updated answer and counterclaim in federal court against Righthaven.

The new federal filing is similar to a complaint filed on behalf of Eiser and her Tea Party group in state court in South Carolina on June 13 against Righthaven, The Denver Post and others.

The June 13 suit was the first suit or counterclaim to be filed against The Denver Post over its role in the Righthaven lawsuits.

Righthaven charged in a no-warning lawsuit against Eiser that she posted a Denver Post column on her blog, charges denied by Eiser. The column by Mike Rosen was called “A letter to the Tea Partyers.”

The new 119-page federal answer and counterclaim levels 56 charges at Righthaven covering allegations ranging from racketeering to violations of the federal Fair Debt Collection Practices Act.

The claim charges Righthaven lacked standing to sue over Review-Journal and Denver Post material, that it filed “extortionate lawsuits” to extract settlements from defendants and that these suits had a “dramatic chilling effect on expression on the Internet.”

“Righthaven conducted a pattern of racketeering activity. The racketeering activity consisted of extortion, mail fraud and wire fraud,” the new court filing says. “Specifically, Righthaven engaged in an intentional scheme to extort and defraud its targets and to obtain money or property from them through false or fraudulent pretenses, representations, threats and promises.”

“Right now, we’re just gathering evidence. We want to talk to other Righthaven victims. We are very interested in talking to them,” said one of Eiser’s attorneys, Todd Kincannon of the Kincannon Firm in Columbia, S.C.

Righthaven has not yet responded to this new court filing, but it insists it has standing to sue and in the past it has said its no-warning lawsuits are needed to thwart extensive online infringements of newspaper material.

Also, techdirt.com writer Mike Masnick commented on Righthaven CEO Steven Gibson’s appearance this week on the TV news discussion program “Face to Face With Jon Ralston.”

During the show, Gibson suggested criticism of Righthaven by some judges is, in part, guidance for future copyright cases.

“I think part of what’s happening here is that the federal judges recognize that Righthaven has hired some of the top lawyers across the country. Copyright lawyers. Harvard law professors. And they understand that we’re affiliated with an organization as reputable as Stephens Media,” Gibson said.

“I think what the judges are saying is ‘listen, folks, Righthaven is filing a lot of lawsuits.’ They understand that we’re potentially genuine with respect to upholding copyrights. They don’t want to see Righthaven competitors potentially come on with not-solid documentation, and they’re giving us guidance as to what the documentation should be,” Gibson told Ralston.

These and other comments caused Masnick to write: “Righthaven has lost badly, and it looks like Gibson hasn’t quite come to terms with how much trouble his company may be in.”

Righthaven has been ordered to file a response next week to an order by Hunt that it show cause why it should not be sanctioned.

Hunt in a June 14 order wrote that Righthaven’s failure to disclose Stephens Media LLC, the owner of the Review-Journal, as an interested party in the litigation involved a “flagrant misrepresentation.”

These disclosures are required by court rules so judges can determine if they have conflicts of interest they would need to disclose, or that would prevent them from presiding over a case.

Hunt also said he believed Righthaven had made “multiple inaccurate and likely dishonest statements to the court.”

One of these, the judge suggested, was that a certain Righthaven standing claim is “flagrantly false — to the point that the claim is disingenuous, if not downright deceitful.”

Health District files second complaint against county over funding

Henderson Fire Department responded to the blaze near Boulder Highway and Equestian drive about 3: 30 p.m.

New store at the cannery is short on gifts, long on spirit

Most have a plethora of overpriced snacks, some shows logo wear, soft drinks and water in the bottle.

But a North Las Vegas locals casino will try something else next week when the cannery open dining room on the fourth of July weekend. Cannery customers will be able to use loyalty Club points for purchases.

"It will look like a miniature, liquor store," said Josh Killian, the cannery, the Director of marketing. "Guests can still pick up toothpaste and deodorant and various sundries. But above all the rows and aisles liquor products. "

With less than three hours to go, the final preparations for tonight's Las Vegas premiere of 15th annual Carnival for electric Daisy. Deadlines can shelve the renewable energy projects

The Department of energy has been teaming with Nevada legislator on the basis of almost every month to announce loan guarantees for renewable energy projects across the Silver State, which is expected to create several hundred jobs.

It has been a pretty good ride, the congressional also (Democrats, really) comment; but it is something that would soon come to an end.

This is not because the Republicans are threatening to deprive money on a program of incentive: it depends on the program is nearing its expiration date, and it is not clear if there is a politically palatable way to extend it.

The problem with that, these developers to the open market is one of price comparison. Wind power and geothermal energy – another large market for Nevada — can compete with the more conventional power production, such as coal-fired plants and natural gas. But solar's not quite it.

Energy Secretary Steven Chu has said that he believes that the price of solar energy will be able to compete with coal energy sources over the next 10 years – a figure developers say is a conservative estimate: they plan to be players in the open market much earlier. But they point out that there is a fair fight right now.

"Incumbents have been appreciated for many years," said Ian Rogoff, Executive Chairman of HelioPower, an integrated energy development company. "Oil and gas tax benefits has been renewed, meaning State aid of these industries has been renewed ... for the most part, these incentives are only letting these new technologies and new industries to compete effectively and compete against incumbents."

Las Vegas Sun: how long have you been a DJ?

Pauly D: since I was 14 years old. I had my first real DJ gig.

LVS: how many nights you are performing as a DJ in Rhode Iceland prior to the Jersey Shore?

P: there were six nights a week that I was DJ's ing of Rhode Iceland — all the various lounges and clubs away.

LVS: is it true that there will be a new MTV show that follows you as a DJ, and if so will you be filming at the Palms?

P: Yes, it is very true, and they come to the Palms. Signed, sealed and delivered. MTV signed on it, and I am happy to.

LVS: why do you Palms is the perfect place for you?

P: of course, the show picked up with my DJ career but I had to show them what I could do, and it is always where I wanted to stop. DJ AM was always a mentor to me and he passed away while I was recording season 1 of the Jersey Shore. It was a dream for me to DJ at the Palms at the rain. They gave me a shot to try and they loved it and they gave me a residency.

LVS: what you want to accomplish with this Palms residence permit?

P: just because you're not labeled as a type of DJ. I am not just a dance DJ. I am not just hip-hop DJ. I am open format. I want to be known as the body rocker. When you leave my club, you had a good time and you remember it.

LVS: as your career where you think you are?

P: this is where I want to be. This is where I am happy. Later down the line, I would like to make some producing and working with other artists.

LVS: what is your favorite part of the Palmer?

P: pool! And rain. Rain is crazy!

LVS: how big is your music library and the type of equipment do you use?

P: I stick with vinyl. I art form, so I have always two turntables. I have a computer with Serato. My library is over two terabytes of music right now.

LVS: are you bringing the Jersey Shore fist-pumping music to Las Vegas?

P: I am known to have fist pump in, so I play a lot of dance music. It is hot right now. And I throw in some hip-hop and rock together.

LVS: what are the five songs that you must have in your mix every night?
